01What the building committee does
The practical answerThe committee arranges care of the shared parts of the building. Owners elect it and oversee its work.
The vaad bayit (ועד הבית) is the owners’ elected representative body for the building’s common property. Its legal name is נציגות הבית המשותף. It is neither a municipal department nor the owner of the building. Members commonly volunteer; payment or exemption from building fees is not automatic.
- Owners make decisions at the general meeting
- The committee arranges work and manages building funds
- Contractors deliver services; owners review performance
Common property includes areas and systems outside the registered apartments: typically the roof, structure, exterior walls, stairs and lift. A system serving all or most owners can remain common property even where it passes through a private apartment. A garden, terrace or roof attached to a particular apartment needs a document-specific check.
Start with the registration extract, condominium plan and bylaws (תקנון). The statutory standard bylaws fill gaps where no registered provision applies. Some unregistered buildings are also covered by statutory management arrangements: absence of condominium registration does not mean there are no shared obligations. This is an Israeli legal framework, not a direct equivalent of every overseas HOA or freehold system.

Back to contents ↑02Authority, meetings and voting
The practical answerFirst identify the decision: an ordinary expense, outsourcing management or changing rights. The type of decision determines the required majority.
The committee may arrange ordinary upkeep and necessary repairs, enter contracts within its authority, collect lawful charges and represent the building in relevant proceedings. It cannot invent penalties, dispose of common property at will or override an owner’s protected rights.
| Decision | Who approves it |
|---|---|
| Routine cleaning, servicing and work within approved arrangements | The committee implements decisions and arranges delivery. |
| Annual expenditure, committee election and ordinary use rules | Normally a majority of votes at a valid general meeting, subject to the bylaws. |
| Handing all or most management and maintenance to a statutory maintainer (מתחזק) | A majority of owners whose apartments carry at least two thirds of the common-property shares: §71(b)(1). |
| Selecting or replacing the particular maintainer | Owners whose apartments carry more than half of the common-property shares: §71(b)(2). |
| Changing contribution rights, property rights or approving improvements | There is no single universal percentage. Consent of affected owners or a project-specific statutory rule may be required. |
Under the standard bylaws, hold an annual meeting no later than 15 months after the previous one. Give at least four days’ notice with an agenda; a posted notice is treated as delivered the following day. The initial quorum is owners of half the apartments, in person or represented. A later meeting on the same day may proceed with any attendance only where the notice provided for it. This does not lower special statutory voting thresholds.
Ordinary voting is one vote per apartment. Representatives need written authority; joint owners should agree their representative. The committee has one to five members. Owners of one third of the apartments may demand a special meeting; if the committee fails to convene it within 14 days, those owners may convene it under the bylaws.
Keep a decision book and a clear record of attendance, proxies, votes, authorised spending and responsibilities. To challenge a decision, obtain the minutes, bylaws and vote calculation; identify the defect in writing and request correction or a fresh meeting. A dispute within the Land Registration Inspector’s jurisdiction may be taken there. Filing a challenge does not itself suspend the decision: interim relief must be requested where appropriate.
Legal terms, in plain English
Quorum means how many apartments must be represented for a meeting to start. A common-property share is the registered share attached to an apartment; it is different from one vote. Minutes record attendance, discussion and decisions. Interim relief is a separate request for temporary protection while the dispute is being decided.

Back to contents ↑03Fees, budgets and financial records
The practical answerAsk for your fee calculation and records for a specific period. Owners can inspect the financial documents at a reasonable time.
The general meeting determines management and maintenance expenditure. Build the budget around service contracts, common-area utilities, required inspections, insurance, planned repairs and an explained reserve. State what the monthly fee includes and which projects require a separate decision. A reserve should have a transparent purpose and calculation.
Section 58 imposes necessary shared expenses on the owner. The default allocation is the apartment’s floor area as a proportion of the total floor area of the apartments, unless the bylaws provide another lawful arrangement. “Everyone has always paid the same” is not necessarily enough. An empty apartment or non-use of a lift does not by itself remove the duty to contribute; special exceptions need separate checking.
| Record | What it should establish |
|---|---|
| Income and expenditure ledger | Dates, amounts, purpose and a link to supporting documents. |
| Evidence for each expense; receipt for income | Who was paid, for what, and which apartment paid. |
| Bank account in the building’s name | Balances and movements that reconcile with the accounts. |
| A financial report every six months | Income, expenditure and balance; the financial year runs January–December. |
| Minutes, contracts and quotations | Who authorised the work, what was ordered and what was supplied. |
The standard bylaws give an owner access at a reasonable time to the accounts, invoices, receipts, related documents and financial reports. Specify the period and records and offer practical appointment times. Inspection rights do not automatically require the committee to scan its entire archive immediately or provide bank login credentials. Agree copying arrangements and avoid circulating unrelated personal data.
- Send a dated, specific request
- Record any refusal and repeat the request
- Raise the issue at a meeting
- If necessary, seek an order for access from the Inspector

The practical answerFor a usual residential tenancy, cleaning and routine servicing are generally tenant costs; equipment replacement is an owner cost. The owner remains responsible to the building. Read the scope and exceptions below.
The owner is responsible to the building for lawful fees, even if the tenant normally makes the transfer. The law and lease decide which costs the tenant ultimately bears. In an ordinary residential tenancy, the tenant can be charged for routine upkeep, including routine management-company services. These protections do not cover every type of lease: if a charge is disputed, first check whether your tenancy falls within the relevant rules.
| Charge | Usual treatment in a covered residential tenancy |
|---|---|
| Cleaning, stairwell electricity, routine gardening and lift servicing | Ordinary running costs payable by the tenant where the lease and law require. |
| Replacing a lift, installing a permanent system or substantial building renewal | Owner expenditure; instalments do not convert it into routine upkeep. |
| Insurance of the building structure | Not a charge to shift to the tenant under these protective provisions. |
| A bundled monthly fee including an equipment replacement reserve | Obtain an itemised split. The label on the bill does not determine responsibility. |
| Damage caused by the tenant | A separate liability issue, rather than an ordinary shared maintenance charge. |
Ask the landlord for a breakdown and committee contact details. Keep receipts identifying the apartment and period. Tenants may use common areas lawfully, report hazards and pursue their landlord’s repair obligations. Voting on the owner’s behalf requires written authority. Full building financial records are best requested through the owner or with proper authorisation.
If the tenant defaults, the committee should contact the owner with a substantiated statement. The owner can pursue the tenant under the lease and applicable law; using security requires the relevant grounds and notice. Neither side may improvise a utility disconnection or eviction. Where classification is disputed, record the undisputed payments and a process for resolving the balance.
Legal terms, in plain English
Running costs keep the building working day to day, such as cleaning, lighting and servicing. Capital costs concern lasting equipment replacement, installation or major renewal. Security means a deposit or guarantee securing obligations under the lease.

Back to contents ↑05Working with a management company
The practical answerCompare the service and price, then check the selection rules and contract. Replacing a company requires both an owners’ decision and a lawful end to the existing agreement.
Hiring a company does not abolish the owners’ meeting or financial oversight. Distinguish an individual service contractor from a statutory maintainer (מתחזק) taking on all or most management and upkeep. The latter triggers the special voting thresholds above; the contract’s label alone is not decisive.
- Compare quotations against the same scope, frequency, emergency cover, materials and VAT treatment.
- Check the company, insurance, references from occupied buildings, staff competence and conflicts of interest.
- Agree who holds building money, who authorises extras and how owners access supporting records.
| Contract term | Why it matters |
|---|---|
| Specific tasks and measurable schedules | A broad promise to “maintain the building” is hard to enforce. |
| Price, indexation, exclusions and limits on extra work | Prevent unapproved additions to the bill. |
| Emergency contact, response times and job log | Make service quality measurable. |
| Reporting, documents, subcontractors and commissions | Expose the actual cost and relevant interests. |
| Term, renewal, termination and handover | Recover funds, keys, codes, contracts and warranties. |
| Insurance and responsibility | Define cover and the claims process. |
A statutory maintainer has the treasurer’s financial duties under the standard bylaws. The committee should compare invoices with the contract and job records; owners should receive understandable reports. A recommended one-year contract is a negotiating practice, not a universal statutory duration.
- Document failures with dates and evidence
- Give the contractual notice and opportunity to remedy
- Pass the required replacement decision
- End the agreement lawfully and organise handover
A replacement vote does not cancel existing contractual obligations. Check notice, duration and exit costs. For a developer-appointed company, separately review §6A of the Sale (Apartments) Law: restrictions on terminating the initial management contract cannot bind buyers beyond the statutory three-year period without the required renewal. That is not the same as every agreement automatically expiring after three years.
The company is accountable for its own breaches. Liability for damage depends on the conduct, contract and legal basis. Committee membership alone does not create personal liability for every building problem, but it does not excuse personal wrongdoing. A contractor dispute may belong in an ordinary court rather than before the Inspector.
Legal terms, in plain English
A statutory maintainer (מתחזק) is a provider entrusted with all or most building management and maintenance. A tort claim is a claim for harm caused, such as damage resulting from poor workmanship.

Back to contents ↑06Arrears and lawful recovery
The practical answerFirst check the account and identify the owner. Send an itemised written demand; if unresolved, follow the lawful recovery process.
First check that the amount is correct and that you are addressing the right apartment owner. Verify the period, expense-sharing formula, meeting decisions and payments already received. Then send a clear calculation with a reasonable date for a response. You can offer instalments and record the terms. There is no universal requirement to give exactly 14 days before every building-fee claim.
- Building and ownership documents, bylaws and evidence of the committee’s authority.
- Meeting resolutions, budget and the legal basis for the contribution.
- A period-by-period ledger, bank records, receipts and relevant invoices.
- The demand, correspondence and delivery evidence.
- For repair charges: necessity, quotations and proof of work.
- Check the amount and defendant
- Send the demand
- File a supported claim
- Arrange service and follow case directions
- Enforce an executable judgment through the lawful process
Claims about statutory shared expenses between the proper parties are commonly heard by the Land Registration Inspector acting judicially. Use the official service to check territorial jurisdiction and current filing options. Identify the parties, facts, amount, legal basis and remedy, attach the evidence and pay the applicable fee. Check the current fee and procedural deadlines at filing. A lawyer is not invariably required; complex parties, counterclaims or jurisdiction issues deserve individual advice.
| Available through lawful procedures | Not a self-help collection tool |
|---|---|
| Reminders, agreed instalments, a claim and enforcement | Disconnecting water or power; blocking lift or home access. |
| Interest and costs permitted by law or awarded | Invented penalties or automatic recovery of every legal bill. |
| Accurate, necessary financial information for owners | Threats, humiliation or unnecessary personal disclosures. |
The committee cannot seize property on its own. Once there is an enforceable judgment, use the execution system (הוצאה לפועל). An owner receiving proceedings should file receipts and objections within the deadlines in the case documents, rather than simply ignore the demand.
Legal terms, in plain English
A claim is a written demand submitted for a decision against another party. Service means delivering case papers under procedural rules. In these disputes the Inspector acts judicially, rather than simply visiting to inspect a building. Enforcement is the lawful process of collecting what a decision requires.

Back to contents ↑07Repairs, leaks and emergencies
The practical answerDeal with immediate danger first. Then document the defect and notify the committee and owner. Who pays depends on the source of the problem.
Identify the source of the fault and what the component serves. A damp ceiling does not establish that the upstairs neighbour is liable. A pipe inside a private home is not necessarily private. Obtain a professional assessment and check the registration documents.
| Problem | First responsibility to examine |
|---|---|
| Common roof, exterior wall, shared riser or lift defect | The committee arranges necessary work; owners contribute on the lawful basis. |
| A system serving the private apartment | That owner; landlord–tenant allocation is a separate question. |
| An attached terrace, garden or roof | Check registration, structure and defect source; the name alone is not enough. |
| Damage to decoration, furniture or belongings | A separate compensation claim: causation, legal responsibility, insurance and forum must be established. |
- Immediate danger: secure the area and contact the appropriate emergency service
- Record the fault, date, photos and expert findings
- Notify committee and owner in writing
- Agree the necessary scope and cost
- Keep completion records, invoice and warranty
The committee must address necessary common-property maintenance. Urgent containment of a dangerous leak should not wait for a decorative renovation plan. Equally, urgency does not justify unrelated upgrades. A major planned project needs an assessment, comparable quotations, funding and the appropriate decision.
The standard bylaws allow an owner to require a common-property repair where the defect may affect their apartment or its value. Owners must allow access needed for common works; damage caused by those works is restored at shared expense under the bylaws. This is not permission to force entry: disputed access must be obtained lawfully, including a judicial order where needed.
If the committee fails to act, send a documented request with a deadline proportionate to urgency, seek a meeting, and consider a repair order and interim relief from the Inspector. Dangerous structures may also require municipal involvement. Where no functioning representation exists, an application for an externally appointed representative is available.

Back to contents ↑08Before buying or renting
The practical answerCheck not only the monthly fee, but approved work, debts and the management agreement.
- Who is the committee contact and when was it elected?
- What does the monthly fee include? Are reserves or extra levies separate?
- Are major roof, facade or lift works already approved or being discussed?
- Does the apartment owe money? Does the building owe contractors? Are there disputes or insurance claims?
- What do the latest report, fund balance and management agreement show?
- Do the bylaws contain special contribution rules or attached property?
- How will charges before and after handover be allocated in your contract?
Before buying, obtain a statement of the apartment’s account and have your lawyer review the relevant resolutions. A zero current balance does not mean there is no future repair liability. Before renting, record the running/capital split, who forwards notices and how payments are evidenced.

The practical answerChoose a template, fill in the blanks and keep evidence that it was sent.
Include only relevant information and retain delivery evidence. A clear request is more useful than accusations.
Request to inspect records
I own apartment __ at __. Please arrange a reasonable time to inspect the income and expenditure ledger, financial report and supporting documents for __, including __. I can attend on __. Please confirm a suitable time and copying arrangements. Name, date and contact details.
Report a defect
I am reporting __, first noticed on __. The suspected source is __; photographs / a professional report are attached. The effects are __. Please arrange an inspection and necessary repairs, and confirm the responsible person and timetable. Access is available __. Identify any immediate danger separately.
Payment request
The account for apartment __ for __ shows charges of ₪__, payments of ₪__ and a balance of ₪__. The basis and itemised calculation are attached. Questions people actually ask
Do I pay if my apartment is empty?
Yes. Vacancy alone does not remove the owner’s contribution obligation.
I live on the ground floor. Can I refuse lift fees?
Non-use alone does not exempt you from ordinary upkeep. Installing a new lift and particular statutory exceptions are separate questions.
Can a WhatsApp message increase the fee?
It can communicate a decision, but it does not replace a lawful budget, authority and decision-making process.
Can I stop paying until I see the accounts?
Not automatically. Seek disclosure and challenge specific charges separately.
Should every apartment pay equally?
The default is proportional floor area. Check the bylaws and legal basis for any different arrangement.
Must a tenant fund a replacement lift?
In an ordinary covered residential tenancy, capital replacement is owner expenditure. Routine servicing is different.
Can we immediately sack a poor management company?
Document the failure and check cure, notice and termination provisions. The replacement vote and ending the contract are separate steps.
Can I repair a leak and deduct the price?
Reimbursement is not automatic. Document notice, urgency, necessity and reasonable cost; unilateral deduction can create a separate debt dispute.
Can we block a debtor’s lift access?
Not as a self-imposed collection penalty. Use the lawful recovery process.
What if nobody agrees to serve?
Convene a meeting to arrange management. Where there is no functioning representation, an application to the Inspector for an external appointment is available.
Does a WhatsApp poll count as a meeting?
Not automatically. Notice, agenda, authority, quorum and the applicable majority still matter.
Do I automatically inherit the seller’s debt?
Do not rely on that blanket statement. Check the charge, period and transaction, and expressly address arrears and approved projects in the sale contract.
